Online Store Terms and Conditions 

§1

Preliminary Provisions 
1. The online store Institorium, available at www.institorium.pl, is operated by Joanna Żurek conducting business activity under the name Joanna Żurek, entered in the Central Register and lnformation on Economic Activity (CEIDG) kept by the minister competent for economy, NIP 681955466, REGON 122553285, BDO 000587478. 
2. These Terms and Conditions are addressed to both Consumers and Entrepreneurs using the Store and define the rules of using the online store as well as the rules and procedure for concluding Sales Agreements with the Customer at a distance through the Store. 

§2

Definitions 
1. Consumer -a natural person concluding an agreement with the Seller through the Store, the subject of which is not directly related to their economic or professional activity. 
2. Seller -a natural person conducting business activity under the name Joanna Żurek, entered in the Central Register and lnformation on Economic Activity (CEIDG), NIP 6831955466, REGON 122553285. 
3. Customer -any entity making purchases through the Store. 
4. Entrepreneur -a natural person, legal person and an organisational unit without legal personality to which separate legislation grants legal capacity, conducting business activity in their own name, using the Store. 
5. Store -online store operated by the Seller at www.nolensvolens.pl 
6. Distance contract -a contract concluded with the Customer within an organised system of concluding distance contracts (within the Store), without the simultaneous physical presence of the parties, using exclusively one or more means of distance communication up to and including the moment the contract is concluded. 
7. Terms and Conditions -these Store regulations. 
8. Order -a declaration of will of the Customer submitted using the Order Form and aimed directly at concluding a Sales Agreement for a Product or Products with the Seller. 
9. Account -the customer account in the Store, where data provided by the Customer and information about Orders placed by them in the Store are collected. 
10. Registration Form -a form available in the Store enabling the creation of an Account. 
11. Order Form -an interactive form available in the Store enabling the placement of an Order, in particular by adding Products to the Cart and specifying the terms of the Sales Agreement, including the method of delivery and payment. 
12. Cart -an element of the Store software in which the Products selected by the Customer for purchase are visible, and it is possible to determine and modify Order data, in particular the quantity of products. 
13. Product -a movable item/service available in the Store that is the subject of the Sales Agreement between the Customer and the Seller. 
14. Sales Agreement -a product sales agreement concluded or entered into between the Customer and the Seller via the online store. The Sales Agreement also means ­depending on the characteristics of the Product -a contract for the provision of services and a contract for specific work.

6. The Customer may contact the Seller by telephone from Monday to Friday, excluding public holidays, between 10:00 and 18:00. 

§4 

Technical Requirements 
To use the Store, including browsing the Store's assortment and placing orders for Products, the following are required: 
a. an end device with Internet access and a properly configured web browser such as Internet Explorer, Mozilla Firefox, Google Chrome or another updated and properly configured browser 
b. an active e-mail account (email) 
c. cookies enabled 

§5 


General lnformation 
1. To the widest extent permitted by law, the Seller shall not be liable for disruptions, including interruptions in the functioning of the Store caused by force majeure, unlawful actions of third parties or incompatibility of the online store with the Customer's technical infrastructure. 
2. Browsing the Store's assortment does not require creating an Account. Placing Orders by the Customer for Products available in the Store's assortment is possible either after creating an Account in accordance with § 6 of the Terms and Conditions or by providing the necessary personal and address data enabling the execution of the Order without creating an Account. 
3. Prices given in the Store are in Polish zlotys or in euros if the Customer has selected this currency in the options available on the Store's website, and are gross prices. 
4. The finał (total) amount payable by the Customer consists of the price of the Product and the cost of delivery (including transport, delivery and postał charges), of which the Customer is informed on the Store's pages when placing the Order, including at the moment of expressing the will to be bound by the Sales Agreement. 
5. lf, due to the nature of the subject of the Agreement, it is not reasonably possible to calculate the finał (total) price in advance, information on how the price will be calculated, as well as on transport, delivery, postał charges and other costs, will be provided in the Store in the Product description. 

§6 


Creating an Account in the Store 
1. To create an Account in the Store, the Registration Form must be completed. lt is necessary to provide the following data: first name and surname, delivery address of the Products (or parcel locker number in case of lnPost delivery), contact telephone number, email address. 
2. Creating an Account in the Store is free of charge. 
3. Logging into the Account is done by entering the login and password established in the Registration Form. 
4. The Customer may at any time, without giving any reason and without incurring any costs, delete the Account by sending an appropriate request to the Seller, in particular by e-mail or in writing to the addresses provided in§ 3. 

§7 


Rules for Placing an Order 
a. Arising from the Agreement concluded with the Seller. 
b. The Consumer is entitled to apply to the provincial Trade lnspection inspector, in accordance with Art. 36 of the Act of 15 December 2000 on the Trade lnspection (Journal of Laws of 2014, item 148, as amended), with a request to initiate mediation proceedings for the amicable settlement of the dispute between the Consumer and the Seller. 
c. The Consumer may obtain free assistance in resolving the dispute between them and the Seller, also using the free assistance of the district (municipal) consumer ombudsman or a social organisation whose statutory tasks include consumer protection (e.g. Federation of Consumers, Polish Consumers Association). 

§13 


Personal Data in the Online Store -GDPR 
In connection with the entry into force on 25 May 2018 of the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natura! persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), we provide the following information in fulfilment of the information obligation. 
1. The controller of personal data of Customers collected through the online store is the Seller. 
2. Personal data of Customers collected by the controller through the online store are collected for the purpose of performing the Sales Agreement, and if the Customer gives consent -also for marketing purposes. 
3. Recipients of personal data of Customers of the online store may be: 
a. In the case of a Customer using postał or courier delivery in the online store, the Controller makes the collected personal data of the Customer available to the selected carrier or intermediary performing shipments on behalf of the Controller. 
b. In the case of a Customer using electronic payments or payment card in the online store, the Controller makes the collected personal data of the Customer available to the selected entity handling the above payments in the online store. 
4. The Customer has the right to access the content of their data and to correct it. 
5. Providing personal data is voluntary, however failure to provide the personal data indicated in the Terms and Conditions necessary for concluding the Sales Agreement results in the impossibility of concluding this Agreement. 
6. The data subject has the right to access their data and receive a copy thereof, the right to rectification of their data, the right to erasure of data, the right to restriction of processing, the right to object to processing, the right to data portability, the right to lodge a complaint with a supervisory authority, the right to withdraw consent to the processing of personal data. 
7. Categories of data processed: we process email address and data that the user voluntarily and knowingly enters when using the services of our online store. 

§14 

lnformation on cookies 
This website uses cookies. Below are detailed information: 
1. "Cookies" should be understood as IT data stored in end users' devices, intended for using websites. In particular, these are text files containing the name of the website from which they originate, the time of storage on the end device and a unique number. 
2. The service does not automatically collect any information, except for information contained in cookies. 
3. Cookies are intended for using the service pages. The operator uses these files to: 
a) enable logging in and maintaining a user session on each subsequent page of the service 
b) match the content of the website to the individual preferences of the user -above all, these files recognise their device to display the page according to their preferences 
c) create anony mous statistics excluding the possibility of identifying the user 
4. Cookies used by the operator's partners, including in particular website users, are subject to their own privacy policies. 
5. In order to ensure the security of the data entrusted to us, interna! procedures and recommendations have been developed to prevent data from being made available to unauthorised persons. We monitor their performance and constantly check their compliance with relevant legal acts -the Personal Data Protection Act, the Act on Providing Services by Electronic Means, as well as all kinds of implementing acts and Community legislation. 
6. By default, web browsing software allows cookies to be placed on the User's end device. These settings can be changed by the User in such a way as to błock the automatic handling of "cookies" in the browser settings or to inform about their sending each time to the user's device. 
7. Users of the Service may change cookie settings at any time. Detailed information on the possibilities and methods of handling cookies is available in the software (web browser) settings. Example options for editing in popular browsers:

8. The Service Operator informs that changing settings in the user's web browser may prevent the correct operation of the Websites. 

§15

Finał Provisions 
1. Agreements concluded through the online store are concluded in Polish. 
2. The Seller reserves the right to amend the Terms and Conditions for important reasons, i.e.: changes in legal provisions, changes in payment and delivery methods ­to the extent that these changes affect the implementation of the provisions of these Terms and Conditions. The Seller will inform the Customer of each change at least 7 days in advance.

4. The Customer has the right to use out-of-court methods of handling complaints and pursuing claims. For this purpose, they may submit a complaint via the EU online ODR platform available at: http://ec.europa.eu/consumers/odr/
